ІНСТИТУТ ПОХОДЖЕННЯ ДИТИНИ В СІМЕЙНОМУ ПРАВІ УКРАЇНИ

Abstract

У статті досліджено питання походження дитини, яке є актуальним та найбільш поширеним явищем, що потребує уваги, розвитку та правового підґрунтя. Пояснено, що інститут походження дитини регулює різноманітні аспекти, що стосуються дітей та їх батьків, надає можливість подружжю отримати права та обов’язки стосовно їх дитини, а також визначити його походження згідно норм законодавства. Показано, що зв'язок, який виникає між батьками та дітьми, включає як майнові, так і немайнові права та обов’язки. // The article deals with the issue of a child’s origin, which is the most important and widespread phenomenon that requires attention, development and legal background as the child's origin institution regulates various aspects relating to children and their parents. It allows couples, receive the rights and obligations relating to their child, and also determine its origin under the legislation. It was showed that the connection that appears between parents and their children has pecuniary as well as non-pecuniary rights and responsibilities.
