Abstract:
В статті проаналізовано результати наукового осмислення заподіяння моральної шкоди та її компенсації у вітчизняному науковому дискурсі на межі ХХ–ХХІ ст. Виокремлено галузеві спрямування та аспекти вивчення проблеми. Встановлено, що основними з-поміж них в дисертаційних працях та фахових публікаціях 2000–2010-х рр. є загальнотеоретична, філософсько-правова концептуалізація феномену в контексті природного права; визначення поняття, юридичної природи моральної шкоди в цивільному праві України, дослідження питань її презумпції та компенсації, зокрема за трудовим правом. Підкреслено, що подальшого дослідження потребують правові засоби компенсації моральної шкоди в сфері медіа-права, авторських та суміжних прав. // The article deals with the results of scientific understanding of moral injury sustaining and its damages in the domestic scientific discourse at the turn of the XXІst century. The branch directions and aspects of the problem studying are distinguished. The author identifies the main ones in the theses and professional published works of 2000–2010; they are the general-theoretical, philosophical and legal conceptualization of the phenomenon in the context of natural law; the definition of the concept and legal nature of moral injury in civil law of Ukraine, the research of the question of its presumption and damages, in particular, of labor law. It was emphasized that legal means of moral injury damages in the field of media law, copyright and related rights need following investigation.
